Notable Cases Instituted By Directorate Of Public Prosecutions

  1. THE STATE OF LAGOS V. OKWUMO NWABUFO & 3 ORS.

This is a case in which one Cynthia Osokogulo was lured to Lagos by the Defendants whom she met on the social networking site ‘facebook.com’. She was declared missing and later found dead at Cosmilla Hotel, Festac Town. The Defendants are being charged for Murder, Stealing and Reckless Negligent Acts. The case is for further trial of DW1.

  1. THE STATE OF LAGOS STATE V BULOMO KALO

The defendant was charged for the murder of Engineer Funsho Williams. The    prosecution called 6 witnesses and has closed its case. The Defence as opposed to opening its case has filed a no case submission, judgment was delivered and the Defendants are discharged and acquitted.

  1. FRN V ALI AMODU & ORS

The Defendants were charged for Terrorism related offences before Honourable Justice Buba of the Federal High Court of Nigeria. The 1st to 3rd Defendants were convicted as charged whilst the 4th Defendant was discharged and acquitted. The Defendants have filed an Appeal.

  1. THE STATE OF LAGOS V ESTHER FAITH & ORS

The Defendants were charged for the offences of Conspiracyto commit a Felony to wit Kidnapping, Kidnapping, Conspiracy to commit Robbery and Armed Robbery. The Prosecution and 1st to 5th Defendants signed a Plea and Sentence Agreement and they were convicted accordingly, whilst trial continues in respect to the 6th and 7th Defendants. The case has adjourned for filing of Final Written Addresses.

  1. THE STATE OF LAGOS V ISIAKA WAIDI & ORS

This is a case whereby market people in Ejigbo took the law into their hands when they punished two Sisters and their mother for stealing pepper by beating them and pouring pepper into their private parts. The Defendants were charged with the offences of Unlawful Assembly, Trial by Ordeal, Assault Occasioning Harm, Causing Grievous Harm, Maliciously Administering Poison with intent to Harm, Deprivation of Liberty, Attempted Murder, Sexual Assault by Penetration, Obtaining Money by False Pretence and Neglect to Prevent a Felony before Honourable Justice Ipaye of the Ikeja High Court.

  1. NDI OKEREKE ONYUIKE V THE PEOPLE OF LAGOS STATE & ORS

This is a case whereby the former Director General of the Nigerian Stock Exchange was charged for stealing before Honourable Justice Balogun of the Lagos High Court. An interlocutory application was brought for the quashing of the information filed and the court dismissed the same.

The Defendants subsequently appealed to the Court of Appeal, but their appeal has been dismissed and trial is to go on at the trial Court, They have subsequently appealed against the judgment of the court of Appeal to the Supreme Court. Briefs have been filed and hearing dates being awaited.

  1. THE STATE OF LAGOS V OLUWASEUN OLADAPO

This is a case where the family of Barrister Fadipe was attacked by an armed robber, which led to the death of Barrister Fadipe and his mother in-law. The Defendant is being charged for Murder. The Prosecution has opened its case and has called 4 Witnesses in the proof of it case. It has been adjourned for continuation of trial.

  1. THE STATE OF LAGOS V KENECHUKWU OKONKWO

This is a Rape case before Hon. Justice Ipaye, same has been adjourned for Defence to open its case.

  1. THE STATE OF LAGOS V REGISTERED TRUSATEE OF SYNAGOGUE CHURCH & 3 ORS.

The Prosecution is to perfect service of the processes (Information and Proof of Evidence) on the Defendants.

  1. THE STATE OF LAGOS V ADEDEJI IDOWU & 3 ORS.

This is a case of Conspiracy, Armed Robbery and Murder, where a son connived with his wife and two armed robbers to rob his mother which led to the death of his mother. The Prosecution has called 3 witnesses; PW4 is in the box now. Matter was adjourned for continuation of Trial within Trial.

COURT OF APPEAL

Some of the cases being handled by the Directorate in the Court of Appeal are:

  1. SULE SANNI Vs THE STATE–this is a case of Fundamental Human Right. Briefs have been filed.
  2. IBRAHIM FATAI Vs THE STATE – This is a case of Conspiracy and Armed Robbery. Application for extension of time to file Appeal is pending.
  3. CYPRIAN AMOETE Vs THE STATE – This is a case of Assault and Unlawful Carnal Knowledge. Briefs are being filed at the Court of Appeal.
  4. TALIMU RASHIDI PEKEKU Vs THE STATE – This is a case of Murder. Motion to quash Appeal is pending. 

 

SUPREME COURT CASES

Some of the cases being handled by the Directorate in the Supreme Court are:

  1. CHUKWUEMEKA EZEUGO (REVEREND KING)Vs THE PEOPLE OF LAGOS STATE- Reverend King’s appeal against his conviction was dismissed at the Court of Appeal and he further appealed to the Supreme Court. Briefs were duly filed and arguments heard. Same has been adjourned for judgment to the 26th of February, 2016. 
  1. MUSLIM FOLORUNSHO Vs HE PEOPLE OF LAGOS STATE–this is a case of Murder. Appeal against his conviction was dismissed at the Court of Appeal and he further appealed to the Supreme Court. 
  1. IDRIS ADAMU AND YAHUZA MUSA Vs THE STATE – This is a case Conspiracy to Commit Robbery.

There are 36 other cases in the Supreme Court.

 

 

SOME NOTABLE JUDGMENTS

  1. STATE V. AKOLADE AROWOLO

This is a tragic case in which a young unemployed graduate was alleged to have killed his banker wife. The case has been concluded and judgment was given in favour of the state. The Defendant was sentenced to death by hanging.

  1. THE STATE OF LAGOS V SEGUN FABUNMI-

This is a case of indiscriminate shooting by a senior police officer where a young man was shot dead and many others got injured. He was charged for murder and causing grievous bodily harm. Judgment has been delivered, the Defendant was Convicted for Manslaughter and sentenced to 15years Imprisonment to run concurrently.

  1. ISMAILA FATOKI V THE STATE OF LAGOS-

This is a case of Armed Robbery. The Defendant was convicted at the High Court. Defendant appealed and the appealed was allowed on the ground that the Prosecution was unable to discharge the burden of proof and there’s no proper Identification. He was discharged and acquitted.

  1. FABIAN MATTHEW V THE STATE OF LAGOS

This is a case of Armed Robbery. The Defendant was convicted at the High Court. Defendant appealed and the appealed was allowed on the ground that the Prosecution was unable to discharge the burden of proof and there’s no proper Identification. He was discharged and acquitted.

  1. KINSLEY AKHAGBUE V THE STATE OF LAGOS

This is a case of Armed Robbery. The Defendant was convicted at the High Court. Defendant appealed and the appealed was allowed on the ground that the Prosecution was unable to discharge the burden of proof and there’s no proper Identification. He was discharged and acquitted.

  1. THE STATE OF LAGOS V TAOREED OSENI

The Defendant was charged with the offence of Rape. He was sentenced to 12 years imprisonment.

  1. THE STATE OF LAGOS V CHIDI IBIAM

The Defendant was charged with the offence of Defilement. He was sentenced to 21 years imprisonment.

  1. THE STATE OF LAGOS V MICHAEL AKINWUNMI & JULIUS AKINWUNMI

The Defendants were charged for Other Forms of Sexual Abuse and Exploitation not specifically provided for by the Child Rights Law under the Child Rights Law of Lagos State. They were sentenced to 7 years imprisonment.
